CSO Calls For Review Of IMC Code Of Practice

The Independent Media Code of Practice shows a clear bias towards accusers, when individuals are summoned before the commission on allegations of defamation or violating the regulations set forth by the Independent Media Commission. This results in a lack of opportunities for the accused to seek compensation from the complainant, in the event of a successful defense, while still facing fines if they are found liable.

The League of Democracy Advocates  (LoDA) is calling for a review of the provisions in the Code of Practice that addresses consequences for failing to comply with accuracy requirements. It is proposed that in addition to a fine not exceeding Le1,000,000 being levied against the Proprietor/ Proprietress or Publisher, there should also be provisions for compensation for allegations that cannot be justified by the complainant(s). This proposed change aims to serve as a deterrent for baseless and fictitious allegations that tend to hinder the work of the accuser and waste the commission’s time unnecessarily.

By including compensation for unjustified allegations, it will encourage individuals to thoroughly investigate and substantiate their claims before making a complaint. This will promote accountability and integrity within the industry, as frivolous claims will no longer be tolerated. Additionally, by holding accusers accountable for their actions, it will protect the reputation of those who have been wrongly accused, and prevent the spread of false information that can harm individuals, organisations or institutions.

Moreover, implementing this change will also help streamline the investigation process and ensure that the commission’s resources are allocated effectively. By discouraging baseless allegations, the commission can focus its efforts on addressing legitimate complaints and promoting ethical practices within the industry.

In conclusion, this proposed revision will not only enhance the credibility of the Code of Practice, but also create a more fair and efficient system for addressing complaints within the profession.
