The Freetown High Court No.1 Presioded by Justice AlhajiMomoh Jah Stevens has on Monday 11th July,2022 announced that the Timber businessman Henry Kabia who pleaded guilty to the charge of the murder of his romantic rival Samuel Kamara at the inception of the trial in Febuary this year has been awarded a 25 years jail term to be served at the country’s maximum prison known as (Pademba Road Prison).
The presiding Judge,honourable Justice Stevens in passing his sentencing told the jam parked court room that the convictHenry Kabba met all the elements that constitute the act ofmurder
He said the defence team’s plea of mitigatiom on behalf of the convict on grouds of emotional and unstable state of mind of the convict Henry Kabba at the time of the act has no legal legs to stand on.
Justice Steven noted that the awarded 25 years sentence is meant to serve as a lesson to both the convict Henry Kabba and the public.
State cousel, Yusuf Issac Sesay who led the prosecution in matter of Henry Kabba versus the state told news men after the sentencing was pronounced that , “We are happy that justice has been served, our case was clear from the on set and that we relied on our evidence. The particulars of offence as presented in court at the inception of the case speaks to an account which shows that the convict Henry Kabba travelled from Makeni to Freetown unannouced and went straight to his Newcastle street,Kissy residence where he he shares temporal shelter with his fiance Isatu Turay,on arrival he use his key and entered into the room where discovered that Isatu was in a romantic mood with the deceased. The account further explained that the discovery led the convict to walk his way to the living room and fetch a kitchen knife which he ended up using to murder deceased. With today’s sentence, he has now been held accountable for his horrifying actions.”
Furthermore, according to the evidence, the convict then exited through the door while his girlfriend screems . While Isatu was screaming the convict remarked “You chose him! You made me do this!” Neighbours arrived and arrested the convicted as he attempted to flee.
Family members of the deceased Samuel Kamara said to this media that they are relieved that they have had a closure on the matter and they believe their late family member soul will now rest in peace.
Pa Jumu Kabba, a family member of the convict Henry noted in an interview with this medium that they know their son to be a non-violence person and they are aware of the huge investmenthe made to demonstrate the love he had for his girlfriend Isatu “ her betrayal of love and trust provoked our convicted son’s action. The sentence of 25 years was too much for a true lover who only reacted to sycological stress.
